Today's Inside EPA is reporting that several environmental groups are seriously considering going to court soon to force EPA to issue an endangerment finding for greenhouse pollution. EPA's initial refusal to make such a finding gave rise to Mass. v. EPA, in which the Supreme Court instructed EPA to reconsider. The court's opinion included strong language suggesting that the finding should issue, but recent remarks by EPA Administrator Johnson suggest he believes the fuel efficiency mandates in the new energy law is an adequate response. An EPA spokesperson said EPA will "soon" indicate how the new law affects its regulatory options. Stay tuned.
